HC freezes accounts of ex-NRB bank MD, ILFSL chair

Appoints Ibrahim Khalid as new ILFSL  chairman

The High Court Division on Tuesday directed the Bangladesh Bank and all the private banks to freeze bank accounts of NRB Global Bank’s former managing director PK Halder, his five relatives, Bank Asia Limited’s former managing director Erfanudidn Ahmed and Halder’s cohort Uzzal Kumar Nondi for embezzling Tk 3,000 crore from different leasing companies by  taking loans in the name of fake companies

A company bench of Justice Muhammad Khurshid Alam Sarkar also directed the home secretary and the inspector general of the police to seize passports of PK Halder, now abroad, his five relatives, his mother Lilaboti Halder, brother Pritish Kumar Halder, wife Susmita Saha, cousins Amitav Adhikari and Avijit Adhikari and  Erfanuddin Ahmed and Uzzal Kuamar to stop them from leaving the country. 

As shareholders, directors and top executives  of 13 fake companies, P&L international, P&L Agro, P&LVenture, P&L Business Enterprise, Hal International, Hal Travels, Hal Trip, Hal Capital, Hal Technology, Anon Comical, Northern Jute, Sukhada Limited and Reptile Farma, the seven persons borrowed and defalcated the money of a number of leasing companies.

The court also directed the home ministry to collect detailed information of PK Halder, all the share-holder directors of the fake companies, his relatives and cohort Uzzal.

The court directed the Joint Stock Company  to furnish within 15 days the detailed information about the shareholder directors and top executives of the 13 fake companies.

The court directed the present chairman, managing director and other independent directors of the International Leasing and Financial Services Limited known as ILFSL to submit within 15 days the collaterals and all the papers submitted by PK Halder and his concerns and companies with the loan application to borrow from ILFSL.

The company bench also directed the Bangladesh Bank and all the private banks to seize bank accounts of the 11 shareholder directors and the top executives of ILFSL including its chairman and former Janata Bank managing director MA Hashem, managing directors Nurul Alam and Rasheudl Haque, independent directors Zahirul Alam, Nasim Anwar, Bashudeb Banerjee, Momtaz Begum, Nowsherul Islam, Anwarul Kabir, Nuruzzaman and Muhammed Abul Hashem.

The court also directed the home secretary and the IGP to seize passports of the 11 directors of ILFSL to stop them from leaving the country.

The court directed the home secretary to submit a compliance report within 15 days about the seizure of the passports.

The court also directed Bangladesh Bank governor to submit the personal and business bank statements of the 19 persons for last five years within 15 days.

The court appointed former BB deputy governor Ibrahim Khaled as chairman and independent director of ILFSL replacing present chairman MA Hashem.

The court, however, allowed the present chairman to continue as a director of the ILFSL board.

It said that the new ILFSL chairman would be entitled to get Tk three lakh as monthly honourium and a well-furnished office room.

The court directed the ILFSL to appoint a special assistant to the new chairman with a monthly remuneration of Tk 50,000.

The bench issued 12 directives after hearing a company writ petition filed by two clients of ILFSL in December 2019 seeking winding up  ILFSL.

The two petitioners had crores of Taka as fixed deposit with the ILFSL, submitted their  lawyers, Kamalul Alam and ASM Shahriar Kabir.

After maturity, the petitioners applied to en-cash their money but the ILFSL informed them that it had no ability to pay their money.

On January 12, ILFSL’s lawyers Mehedi Hassan Chowdhury and Mahfuzur Rahman Milon submitted that the leasing company was not in a position to honour its creditors at a timew.
