‘Torturing’ Lawyer’s Assistant

Ex-Boalkhali OC, 7 other cops sued

The Chattogram Metropolitan Magistrate’s Court on Monday asked the Police Bureau of Investigation to investigate a complaint of a lawyer’s assistant against 11 people, including former Boalkhali police station officer-in-charge Himangshu Das Rana, on charges of torturing him and implicating him in ‘false’ cases.  

Judge Abu Salem Mohammad Noman passed the order taking cognisance of the complaint filed by legal assistant Samar Krishna, 60, also vice-president of Saroatali union Awami League under Boalkhali Upazila in Chattogram.

The other accused are inspector (investigation) Mahbub Alam Akhand, sub-inspectors Ariful Islam, Atiqur Rahman, Abu Bakar Siddiq, Ripon Chakma and Delwar Hossain, assistant sub-inspector Alauddin, expatriate Sanjoy Das and his assistant Sajal Das and Saroatali Union ward no 5 watchman Didarul Islam.

Plaintiff’s lawyer Jewel Das said that that on May 27 2018, a team of seven policemen in plainclothes, led by SI Arif, picked Samar up from Chattogram city’s Court Building area at around 7:10pm and took him to the Boalkhali police station.

He alleged that the police had tortured Samar brutally with consent from OC Himangshu before taking an attempt to kill him in the ‘gunfight’.

On May 28, 2018, Samar’s family contacted senior lawyers of the Chittagong District Bar Association seeking help to know about his whereabouts.

Lawyers called the Boalkhali OC and asked him to produce Samar before the court. The police produced Samar before a Chattogram court showing him arrested in two cases filed over the recovery of yaba pills and firearms.

The court sent him to jail.

After walking out of jail on bail on July 12, 2018, Samar lodged a verbal complaint with Noor E Alam, the then superintendent of police, Chattogram.

Samar alleged that a land-related dispute with their distant relatives Swapan Das and Sanjoy Das, a Bangladesh-born British citizen, led the whole incident.

On July 26, 2018, OC Himangshu was transferred to Chattogram Police Lines for filing the false cases against Samar. He was later transferred to Armed Police Battalion (APBn)

SI Arif and SI Atiq were also closed following the incident.

On August 29, 2019, the district and sessions judge Mohammad Ismail Hossain ordered acquittal of Samar from the two cases by accepting a PBI inquiry report which found no involvement of Samar in the cases.
