The High Court Division on Tuesday directed the Criminal Investigation Department to find out and take action against the perpetrators involved in arresting and detaining Gonoshasthaya Kendra’s agricultural programme officer Awlad Hossain with false warrants.
The court also directed the jail authorities to produce Awlad Hossain before it on January 16 to satisfy it that he was not detained in jail illegally with false warrant.
Awlad is now detained in Sherpur District Jail after staying in three other jails in Rajshahi, Bagherhat and Cox’sBazar.
The court directed the chief judicial magistrate of Sherpur to grant bail to Awlad after verifying whether or not his warrant was false.
The CJM was also directed to ensure Awlad’s release on bail if he was not wanted.
A bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman issued the directives while hearing a writ petition filed by Awlad’s wife Shahnaj Parvin.
Shahnaj’s lawyer Zainul Abedin submitted that Awlad was arrested at his home in Ashulia on October 30 with a false warrant issued in a women and children repression case.
He submitted that but the case docket was sent to Cox’sBazaar Women and Children Repression (Prevention) Tribunal to defer his bail hearing by Dhaka CJM’s court.
When his bail application was filed in the Cox’s Bazar court on November 13, the judge rejected it as Awlad was not named in the case.
Awlad was later shifted to Dhaka Central Jail and from there to Rajshahi Central Jail in another false warrant against another women and children repression case and the Rajshahi tribunal also rejected his bail application saying he was not named in any case.
Later, Awlad was shifted to the Bagherhat and the Sherpur central jails and the tribunals in both the places rejected his bail application as he was not named in any case.
