YOUTH PERSPECTIVE ON LAW

The Pornography Control Act, 2012

THE government of Bangladesh has recently enacted the anti-pornography law. The law is observed to be rigid by its nature and drawn criticism from different quarters of the society. The aim of the act is to control the spread of pornography across the country.

Nowadays apps like Tiktok and Snapchat seem to be the most popular ones amongst the youth. They are often used by urban youngsters. However, Tiktok has proliferated nationwide. The main question that arises here is why large number of juveniles are using such applications? In order to have a close look, the features of the apps are needed to be mentioned.

Starting off with Snapchat, this application contains a unique feature of photos and videos sharing from one end to another. The users often feel comfortable sharing still pictures and clips here because it expires once it is opened by the receivers. If the receiver tries to take screenshots it immediately notifies the sender. The chat history disappears too.

Because of that feature young individuals are getting more interested to share their private photos. Recipients with malevolent intentions are often observed to leak the private images publicly. That trend has become so radical at this time even though it is considered as substitutions of pornographic entertainment to the youth.

Furthermore, Tiktok, formally known as musically, is famous for its vivid feature of creating short videos of leap-syncing. The app allows users to create music videos of 3 to 15 seconds and looping tapes of 3 to 60 seconds. To see scandalous contents the raunchier the content the higher the number of viewers.

Any social platform like Tiktok that incentivises creators with likes and views, runs the risk of opening its doors to soft porn. As a consequence, pornographic content is spreading through Tiktok and youth.

Law and its consequences

According to section 2 of the Pornography Control Act, the definition of pornography includes nude or half nude video and still pictures. Furthermore, it also defines as pornography, any material that is likely to increase sexual sensation or desires.

According to the 2012 Act, the users of the apps may easily be subject to section 8(1) of the act that mentions a punishment of a maximum of 8 years along with a fine of up to TK 200,000, just for capturing the image or video.

Again, according to Section 8(3), for dispersing such material using the internet and the cell phone the user may receive up to 5 years of imprisonment and a maximum fine that is same as the previous section.

Therefore, our youth needs to be more conscious about the usage of such applications. On the veil of entertainment or social networking they are getting involved into pornography which is a punishable crime under the law as discussed. Before it goes too far we need to create awareness amongst the youth.
