The Appellate Division on Thursday upheld the order of the High Court Division granting division I in the jail to acclaimed photographer Shahidul Alam.
A four-judge bench chaired by Chief Justice Syed Mahmud Hossain dismissed the government’s appeal seeking stay on Shahidul Alam’s division 1 jail facilities.
On September 5, the High Court Division granted him Division 1.
The Appellate Division asked the attorney general to explain why the jail authorities hesitated for four days in extending division 1 to Shahidul Alam as the trial court had ordered.
On Thursday, the High Court Division put off hearing Shahidul Alam’s bail application until Sunday following prayer from attorney general Mahbubey Alam seeking time for making his submissions.
It was for the 2nd consecutive day that the hearing had been put off for the same request from the attorney general.
Since Wednesday, Shahidul Alam’s bail petition has been pending with the bench of Justice AKM Asaduzzaman and Justice SM Mozibur Rahman.
The court asked the attorney general to say what would be his reply to the defence stand that Shahidul Alam did not post in facebook live the statement cited by the police for detaining him.
The bench expressed annoyance as the attorney general appeared in the court 90 minutes behind the schedule saying, ‘We need four attorneys general as you were not anywhere.’
The bench reminded him, ‘We have been waiting for you since the morning.’
Supreme Court lawyer Sara Hossain submitted that hearing Shahidul Alam’s bail application was put off time and again to facilitate the attorney general appearance though he behaves the same way in the other hearings too as he loves to keep the judges waiting for him.
She submitted that in this matter life and liberty of a prominent citizen was involved since he had been detained for 60 days but the attorney general and the additional attorney general were wasting time on the same vague plea hampering hearing similar cases of other litigants.
In the courtroom university teachers, right campaigners as well as friends and relatives of Shahidul Alam waited in vain expecting to hear what the attorney general says to obstruct granting bail to the prisoner of conscience.
At Wednesday’s hearing, Sara Hossain submitted that 100 citizens were detained on the same allegation that they had criticized the government and gave incitements to school children’s movement for safe roads and that but for Shahidul Alam all the others were granted bail by magistrates.
Shahidul Alam has been denied bail since August 5 when he was detained after plainclothes police picked him up at his Dhanmondi home.
