No vacation bench of the High Court Division heard the bail application of acclaimed photographer Shahidul Alam over the last 29 days.
Shahidul Alam has been detained since August 5.
His lawyers expressed deep shock and disappointment over the tendency of the superior courts to hear government’s petitions or appeals to deny legal rights to citizens.
They told New Age that they would again move the HCD after it reopens to seek relief for Shahidul Alam in another bench on October 1.
On Tuesday Shahidul Alam’s bail application appeared as 466th and last item on the day’s cause list in the vacation court of Justice Md Rezaul Haque and Justice Abu Taher Mohammad Saifur Rahman that rose for the day after hearing 227 petitions, deputy attorney general Nazibur Rahman told New Age.
Lawyers said that Shahidul Alam’s application was placed at the bottom of the cause list time and again only to kill time and keep it pending.
On Monday too, the same bench did not hear, Shahidul Alam’s bail application as it was the 355th and last item on the day’s cause list.
His application was filed on September 17 but was not placed in the cause list until Sunday though the same bench had given permission to file the application.
On September 4, another vacation bench of Justice Md Ruhul Quddus and Justice Khandaker Diliruzzaman felt embarrassed and refused to hear Shahidul Alam bail application after keeping it pending for five days.
On August 27 Shahidul Alam’s lawyers first moved in the High Court for his bail after the trial court set a long date of hearing it.
