Verdict in Maya’s appeal against conviction Oct 7

The High Court Division said Tuesday that on October 7 it would deliver its verdict in appeal of disaster management minister Mofazzal Hossain Chowdhury against 13 years’ jail to which he was convicted in 2008 by a trial court finding him guilty of accumulating wealth illegally.
During hearing by a bench of Justice Md Nazrul Islam Talukder and Justice KM Hafizul Alam, Maya’s lawyer Abdul Baset Majumder submitted the prayer to send Maya’s case to the trial court for retrial as he could not present proper defence as his client was tried when he was absconding.
Anti-Corruption Commission’s lawyer Khurshid Alam Khan submitted that there was no scope to hold Maya’s retrial as suggested by his lawyer after the Appellate Division directed the High Court Division to dispose of Maya’s appeal on merit.
On June 14, 2015, the Appellate Division revoked a High Court verdict that had acquitted Maya of graft charges overturning a Special Judge’s Court verdict that had sentenced him to imprisonment for 13 years on February 14, 2008.
The Appellate Division had also asked the High Court to dispose of Maya’s appeal on merit.
The Appellate Division gave the directive with the observation that the High Court Division did not apply its judicial mind in giving the verdict in Maya’s appeal on October 27, 2010.
